从激动网起诉土豆网看视频网站版权之痛

版权问题是一个老生常谈的问题了，前不久微软“黑屏”事件其实是一次从技术的层面对知识产权保护的一种善意提醒，不过，在法律手段和教育手段之后，微软迫不得已选择技术手段也侧面反应了知识产权保护的艰难。其实，在任何时候我们都不应该忽视版权，尽管有人称微软的产品卖的很贵，但这并不能成为盗版的借口。

      随着国内知识产权保护力度的加大以及多项举措的出台，多个行业的版权问题也许能逐渐获得解决。目前看来，软件行业、唱片行业、影视业是最容易滋生盗版的地方，在很多情况下，我们为了培养行业持续快速的发展而纵容盗版的滋生，盗版变得一发而不可收拾，无论是搜索引擎还是视频网站，都不同程度存在这种情况。

      拿我们熟悉的视频网站来说，鉴于版权成本过高，早期视频网站主要靠用户上传获得内容，由于缺乏严格监管，很可能滋生盗版。

      最近反盗版联盟起诉土豆网一事让我们把焦点集中到了视频网站的版权问题之上。值得我们注意的是，这个防盗版联盟成员不仅仅有正版内容的提供商，也有一家视频网站------激动网。这种微妙其实把版权与视频网站的关系表现的淋漓尽致，因为同样作为视频网站的激动网同土豆网不一样，前者并不存在盗版问题，而后者正是存在盗版问题。

      激动网是业界最早从事版权内容的视频网站，其内容均来源于官方，而土豆网则是视频分享模式，其内容主要来源于用户上传。二者运营模式上有根本的不同，这才是滋生盗版的核心因素，难怪搜狐董事局主席张朝阳会说“视频分享网站是滋生盗版的基础”，不仅如此，从土豆网的说明我们也能得出相应结论：

      1. 土豆网称“不对用户上传的视频内容做实质性的处理和改变，其为平台服务商，不具备法理地位和能力进行内容合法性的判定和处理”，这有点像我从小偷那儿低价买了被盗的自行车，但由于我本身不具备判定能力，因此不应该承担相应责任。

      我们注意到，既然土豆网称自己是平台，那么准入制就是这个平台首先要解决的问题，否则，良莠不齐的内容必然影响土豆网的长远发展。土豆网必须要建立一整套成熟的准入体系，才能有效规避风险。如果风险无法规避，那就是模式有问题。

      2. 土豆网称版权保护的关键在于权利人的积极参与和资源投入，不仅是视频网站单方面的责任。不过我认为，如果视频网站能投入一部分资金去购买版权，这个问题便可以得到彻底的解决，所以，土豆网的自我辩护其原因只有一个，那就是节约版权上的开支。

      如果视频网站长期纵容盗版可能影响到其他拥有正版版权的厂商的利益，这次起诉土豆网的版权联盟中，正有成员备受盗版所害。该版权联盟成员之一的激动网称获得了独家版权的《精舞门》《放逐》《双食记》《夜上海》等5部电影在土豆网上出现甚至被推荐至首页，由于激动网和土豆网存在一定的行业竞争，此举显然会对激动网造成一定的损失。

      通过以上分析，我们可以看出，土豆网所谓的说明其实暗示了一点，那就是盗版视频和视频分享网站的利益是有密切联系的，甚至可以说它本身就有动机去传播盗版视频。之所以存在回旋的余地，那是因为它本身也很有可能是盗版的操纵者，只不过抓了用户替其背了黑锅而已。

      这场视频维权我们将继续关注下去，随着视频网站的发展壮大，其内容走向正版化是必然。只要这个大前提被确定下来，这场纷争便不可能演变为无休无止的口水战，尽管这样的处理方式比较残酷，但只有通过这样的方式才能逐渐解决视频网站的版权之痛。
